Supplementary affidavit on behalf of petitioner has been filed stating that one more case is pending against this petitioner.

The petitioner seeks regular bail in Bihta P.S. Case No. 602/2018, registered for the offence punishable under Section 30(a) of Bihar Prohibition & Excise Act. In the written report it is alleged that 24.750 litres of illicit foreign liquour was recovered from the rented house of this petitioner.

Learned counsel for the petitioner has submitted that seizure-list is the part of F.I.R. which does not bear signature of either this petitioner or family member of this petitioner.

Patna High Court Cr.Misc. No.74381 of 2018(2) dt.12-12-2018 2/2 Petitioner is in custody since 04.09.2018 having clean antecedent.

Considering the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Patna in connection with Bihta P.S. Case No. 602/2018, subject to the condition that both the bailors will be close relative of petitioner.
