Learned counsel appearing on behalf of the petitioner submits that during the pendency of the present writ petition, the Rent Fixation Case No. 8 of 2013-14/ 07/L.R.-2014 has finally been disposed of by order dated 03.03.2015 passed by the respondent D.C.L.R., Aurangabad, which has been brought on record as Annexure-B to the counter-affidavit filed on behalf of the respondent no. 2 to 5 and Annexure-1 to the supplementary affidavit filed on behalf of the petitioner. He further submits that against the aforesaid order, he filed Appeal/ Revision No. 56 of 2015 before the District Collector, Aurangabad, Bihar. His grievance is that the matter has not been disposed of by the respondent District Collector till date.

After having heard the parties and taking into consideration the materials available on record, the present writ petition is disposed of with a direction to the respondent District

Patna High Court CWJC No.25022 of 2013 (2) dt.08-01-2016 2/2 Collector, Aurangabad (Bihar) to decide the aforesaid Appeal/ Revision No. 56 of 2015 filed on behalf of the petitioner at an early date preferably within a period of three months from the date of appearance of the petitioner before him with a certified copy of the present order. However, before passing any final order, opportunity of hearing must be given to all concerned including the petitioner, besides others.

In order to expedite the matter, the petitioner is directed to appear before the respondent District Collector, Aurangabad with a certified copy of the present order within a period of one month from today, whereafter the respondent District Collector shall decide the aforesaid appeal/revision as per direction made above.

The writ petition stands finally disposed of with the observations and directions made above.
