JUSTICE ARUN KUMAR ORAL ORDER 10-02-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Budha Colony P.S. Case No. 307 of 2016 registered under Sections 406, 420/34 of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act.
Allegation, in brief, is that the informant settled the marriage of his daughter with the petitioner's son and ring ceremony was solemnised and some articles were gifted. It is further alleged that altogether 15 lacs were given by the informant, but thereafter petitioner retreated from his agreement of marriage as demand of Rs. 10 lacs was not fulfilled.
It is submitted that after the ring ceremony, only Rs. 1,51,000/- was given to the informant in his account and some minor gift items which were also returned back to the informant as the son of the petitioner was not ready to marry with the informant's daughter due to some other reason. The learned counsel appearing on behalf of the informant submits that Rs. 15 lacs was incurred by the informant,
Patna High Court Cr.Misc. No.6548 of 2017 (2) dt.10-02-2017 2/2 but only 1,51, 000/- was transferred in petitioner account and rest amount was given in cash.
Having Considered the aforesaid facts and circumstances, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Alakhdeo Singh be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount to the satisfaction of Chief Judicial Magistrate, Patna, in connection with Budha Colony P.S. Case No. 307 of 2016, , subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
