The petitioners Subhash Yadav and Prem Bharti apprehend their arrest in Muffasil P.S. Case No. 109 of 2014, registered for the offences punishable under Section 307 and some other Sections of the Indian Penal Code.
Amal Kumar the informant named the petitioners along with Sunil Yadav, Ajay Yadav and Ram Swarup Yadav and alleged that Sunil assaulted his father on his head but the blow hit on shoulder. The petitioner Subhash Yadav is alleged to have assaulted Binoy Yadav with Pharsa which hit on the right hand thumb and there is no allegation of assault against petitioner Prem Bharti.
Patna High Court Cr.Misc. No.51902 of 2014 (2) dt.07-01-2015 Learned counsel for the petitioners submits that there is case and counter case. The injury on the thumb of Binoy Yadav is simple in nature opined to be caused by hard and blunt object. Considering the facts aforesaid, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Munger in connection with Muffasil P.S. Case No. 109 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
