JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-12-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are in custody since 28.10.2016 and 09.11.2016, respectively, in connection with Siwan, Mufassil P.S. Case No. 182 of 2016, registered for offences punishable under Sections 147, 149, 323, 324, 325 and 307 of Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioners is that they along with some others, came to the informant and assaulted him by means of butt of rifle and gun.

It has been submitted on behalf of the petitioners that general and omnibus allegations have been levelled against the petitioners and similarly situated persons have already been granted bail by other Bench of this Court vide order, dated

Patna High Court Cr.Misc. No.53832 of 2016 (2) dt.15-12-2016 2/2 05.09.2016, passed in Criminal Miscellaneous No. 34046 of 2016. Heard learned A.P.P. also.

Considering the aforementioned facts and circumstances, nature of offence, the period of custody and also the fact that other similarly situated persons have been granted the privilege of bail, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Siwan, Muffasil P.S. Case No. 182 of 2016.
