The petitioner is apprehending his arrest in connection with Khodabandpur P.S. Case No. 149 of 2016 registered for the offences punishable under sections 341, 323, 379, 307/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. In fact, the present case has been lodged in order to save the neck of Bikram Kumar, who is accused in Khodabandpur P.S. Case No. 66 of 2016, lodged by co-accused Rajesh Kumar Gupta, uncle of the petitioner. The aforesaid case was lodged for kidnapping of the informant Shruti Kumari against the husband of the informant

Patna High Court Cr.Misc. No.14138 of 2017 (2) dt.04-05-2017 2/2 Bikram Kumar. Moreover, similarly situated co-accused have been granted bail by the learned Court below vide order dated 04.02.2017, passed by the learned Sessions Judge, Begusarai in ABA No. 1662 of 2016.

Considering the aforesaid fact, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Manjhaul in connection with Khodabandpur P.S. Case No. 149 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
