Petitioner seeks bail in NDPS Case No.01 of 2018 arising out of Motihari Town P.S. Case No.06 of 2018 instituted for the offence under Section(s) 20(b) of the NDPS Act.

Counsel for the petitioner submits that petitioner is in custody since 08.01.2018 in the instant case. It is alleged against this petitioner that petitioner was accused in Motihari Town P.S. Case No.17 of 2017. He was brought to Court for production and on his return from Court, he was checked before entering the jail and 300 gr. Ganja was recovered from his possession.

Patna High Court Cr.Misc. No.74056 of 2018(2) dt.12-12-2018 2/2 This Court finds that petitioner has sufficiently been punished for the act done by him.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge cum Special Judge, Motihari, East Champaran, in connection with NDPS Case No.01 of 2018 arising out of Motihari Town P.S. Case No.06 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
