The petitioner is languishing in custody since 23.12.2018 in a case registered for the offences punishable under Sections 379/411 of the Indian Penal Code. It is alleged that the petitioner was apprehended while taking away the motorcycle of the informant.

It is submitted by learned counsel for the petitioner that the investigation has already been concluded and a statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that the petitioner was caught while taking away the motorcycle of the informant. Considering the period under custody and the fact that

Case No. 331 of 2018.
