JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 25-01-2017 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor representing the State.

The petitioner is aggrieved by an order, dated 24.10.2016, passed by learned Sessions Judge, Khagaria, in Criminal Appeal No. 59 of 2016, whereby he has affirmed an order, dated 18.08.2016, passed by the Juvenile Justice Board, Khagaria, in G. R. No. 1258 of 2016, arising out of Chautham Police Station Case No. 69 of 2016.

The petitioner is a juvenile and he is an accused in a case disclosing offence punishable under Sections 25(1-B)(a)/26 of the Arms Act, 1959.

Patna High Court CR. REV. No.1259 of 2016 (2) dt.25-01-2017 2/2 Learned Counsel for the petitioner has submitted that the petitioner is in custody since 24.06.2016 and the enquiry is yet to be concluded by the Juvenile Justice Board, Khagaria.

Considering the facts and circumstances, I consider it appropriate to dispose of this application with a direction to the Juvenile Justice Board, Khagaria, to conclude the enquiry within a period of two months from the date of receipt/production of a copy of this order. If the enquiry, under Section 14 Juvenile Justice (Care and Protection of Children) Act, 2015, is not completed by the Juvenile Justice Board, Khagaria, within the aforesaid period of two months, the petitioner shall be released forthwith on bail.

This application stands disposed of with the direction, as above.
