JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-01-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Bihiya Police Station Case No. 11 of 2014 registered for the offences punishable under Sections 420,406, 467,468,471/34 of the Indian Penal Code.

The accusation against the petitioners is that they took Rs. 5 lacs from the nephew of the informant on the pretext of providing government job to the informant's nephew. Learned counsel for the petitioner points out that much prior to filing of the present case, the petitioner no. 2 lodged Budha Colony P.S. Case No. 35 of 2012 against the nephew of the informant as well as others in respect of kidnapping of petitioner

Patna High Court Cr.Misc. No.301 of 2015 (2) dt.07-01-2015 2/2 no. 1 and when the prayer for bail of the informant's nephew was rejected by the court and they were put on trial, the informant brought this false case with an intent to put pressure on petitioners. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Ara in Bihiya Police Station Case no. 11 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
