JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-11-2018 The petitioner seeks regular bail in connection with Patori (Sahpura Patori) P.S. Case No. 253 of 2017, registered for offences punishable under Sections 302, 201, 120(B) and 34 of the Indian Penal Code.
Allegation as per F.I.R. is that the son of the informant aged about 12 years left his house, but did not return and also there was a scuffle between the son of the informant and son of one Vinod Rai and informant suspected hand of the petitioner in death of his son.
Submission of learned counsel for the petitioner is that except suspicion there is absolutely nothing against the petitioner. Further submission is that the other co-accused person having similar allegation has already been granted bail by a Coordinate Bench of this Court vide order dated
Patna High Court Cr.Misc. No.68069 of 2018(2) dt.29-11-2018 2/2 25.09.2018 passed in Cr. Misc. No. 51327 of 2018 and the petitioner is in judicial custody since 05.09.2018. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur, in connection with Patori (Sahpura Patori) P.S. Case No. 253 of 2017, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
