Heard learned counsel for the petitioner and learned counsel for the State.

The instant writ application was filed for quashing of the order dated 03.03.2020 dismissing the petitioner's appeal against the compulsory retirement.

Counter-affidavit has been filed; paragraph-12 of which states as follows:- "12. That under reply to the statement made in para17, 18, 19, 20 of the writ petition it is submitted with great respect that in compliance of the order dated 20.07.2011 passed in L.P.A. No. 369 of 2007 the Joint Director Agriculture Patna Division Patna passed order bearing Gayapank No. 9 dated 02.01.2012 and in

Patna High Court CWJC No.9898 of 2021(4) dt.12-09-2023 2/2 compliance of the aforesaid order dated 02.01.2012 by District Agriculture Officer has ordered to pay Rs. 1, 45, 400/- (One Lakh forty five thousand four hundred only) by a letter bearing Gyapank No. 28 dated 05.01.2012 towards earn leave of 300 days and has ordered to pay Rs. 2,38,910/- (Two lakh thirty eight thousand nine hundred ten only) towards provisional gratuity by a letter bearing Gyapank No. 27 dated 05.01.2012."

Learned counsel for the petitioner submits that having taken adjournments earlier, endeavors to contact the petitioner have not yielded any result. He thus submits that liberty be granted to the petitioner to approach the authorities, should any grievance be surviving other than what is stated to have been paid to the petitioner in the counter-affidavit, extracted above.

With such liberty as prayed for, writ application is dismissed.
