2. The petitioner seeks regular bail in a case registered for the offence under Sections 363, 366A/34 of the Indian Penal Code.

3. As per the prosecution case, petitioner is one of the accused persons who have kidnapped the victim.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Petitioner is in custody since 16.07.2022 and has clean antecedent. He further submits that victim in her statement recorded under Section 164 of the Cr.P.C. has stated that she went on her own.

5. Learned A.P.P. has vehemently opposed the

Patna High Court CR. MISC. No.28167 of 2024(2) dt.24-04-2024 2/2 prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st, Saran at Chapra/concerned Court below in connection with Panapur P.S. Case No. 124 of 2022.
