ANJANA MISHRA ORAL ORDER 13-02-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 06.10..2018 in connection with Special Case No.9398 of 2018 (arising out of Patna Junction P.S. Case No.351 of 2018), registered for the offence under Section 30(a) of the Excise Act and Section 273 of the Indian Penal Code.

Learned counsel for the petitioner submits that the alleged recoveries were not from his conscious possession and he has been taken into custody on pure suspicion. It is further submitted that only 22.890 litres of wine are alleged to have been recovered.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on

Patna High Court Cr.Misc. No.76048 of 2018(3) dt.13-02-2019 2/2 bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna, in connection with Special Case No.9398 of 2018 (arising out of Patna Junction P.S. Case No.351 of 2018).
