The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 363, 366A, 372 and 376 of the Indian Penal Code.
The accusation is of kidnapping the minor daughter of the informant by Vikash Thakur @ Fantush. It is alleged against the petitioner that he facilitated Vikash Thakur in commission of the offence.
Learned counsel for the petitioner submits that in 164 Cr.P.C. statement the victim has got her age recorded as 16 years when the learned court below has assessed her age as 18 years, wherein she has stated that she was not kidnapped rather she was recovered from her maternal-aunt's house. No.43035 of 2015 (2) dt.14-10-2015 2/2 petitioner further submits that Vikash Thakur @ Fantush has been acquitted vide order dated 6th October 2015 vide Sessions Trial No.147/2015 by the learned 1st Additional Sessions Judge, Munger. A certified copy of the aforesaid judgment has been produced, let the same be kept on record. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 1st ADJ, Munger in connection with Tarapur P.S. Case No.11 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
