Versus
The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :
For the Petitioner/s : Mr. Raghav Prasad For the Opposite Party/s : Mr. Surendra Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 29.03.2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.
Again, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Mohmmadpur P.S. case no. 127/2013 pending in the court of ACJM I, Gopalganj stands rejected.
However, learned trial court should expedite the trial of the petitioner and conclude the same as early as possible, preferably, within seven months from the date of receipt/production of a copy of this order because the petitioner is languishing in jail custody since 28.1.2014.
It is made clear that if trial of the petitioner is not concluded due to laches of the prosecution within the above stated period of seven months, petitioner may renew his payer for bail before the trial court itself.
