The petitioner apprehends his arrest in connection with Basopatti P.S. Case No. 69 of 2021 for the offences punishable under Section 273, 272 and 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.
Earlier vide order dated 26.08.2022 passed in Cr. Misc. No. 26154 of 2022, the prayer for anticipatory bail of the petitioner was dismissed as withdrawn on the request of learned counsel for the petitioner with a liberty to the petitioner to surrender before the learned court below and seek regular
Patna High Court CR. MISC. No.22551 of 2023(2) dt.12-04-2023 2/2 bail.
Now, learned counsel for the petitioner submits that the charge-sheet has already been filed against the petitioner on 11.04.2021 and on this ground he again moved before this Court renewing his prayer for anticipatory bail. This Court expresses his deep regret to note here that a wrong practice has been adopted by the practicing Lawyer of this Court. I say no more.
In such view of the matter and for the reasons afore-stated, I am not inclined to entertain the prayer for anticipatory bail of the petitioner once again. Accordingly, this application stands dismissed. (Anjani Kumar Sharan, J) anand/- U T
