07-10-2020 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in Ahiyapur P.S. Case No. 100 of 2020, G.R. No. 443 of 2020, registered for the offence under Sections 420, 406, 506 of the Indian Penal Code. As per the prosecution case, the petitioner is alleged to have sold a land through a registered sale-deed in favour of the informant, which was claimed to be government land. It is submitted on behalf of petitioner that it is purely a dispute of civil nature. From bare perusal of khatiyani record as well as sale-deed, it is apparent that said land was the rayati land of the petitioner, which he sold to the informant and later on, the same was got mutated in favour of informant. It is stated in paragraph -3 of the petition that petitioner has no criminal

Considering the aforesaid facts and circumstances, the bail application of petitioner is allowed. In the event of his arrest or surrender within a period of eight weeks from the date of receipt/production of copy of this order, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 100 of 2020, G.R. No. 443 of 2020, subject to condition as laid down under Section 438 (2) of the Cr.P.C.
