JUSTICE SANJAY PRIYA ORAL ORDER 28-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Teghra P.S. Case No. 180 of 2016 instituted for the offence under Section 392 of the Indian Penal Code.
As per written report the motorcycle along with mobile and bag containing ATM cards and other papers of the informant was looted by four miscreants.
Case diary has been received.
The learned A.P.P. has submitted that on the basis of statement given by co-accused in paragraph 83 of the case diary, the name of the petitioner along with other accused has come and the looted motorcycle of the informant was recovered from the house of the petitioner.
Patna High Court Cr.Misc. No.2243 of 2017 (4) dt.28-03-2017 2/2 It has been submitted on behalf of the petitioner that he has no concern with the aforesaid motorcycle. He has clean antecedent. The motorcycle was recovered from the courtyard which is open place and it was kept by co-accused Rajesh Kumar Mahto who has been arrested by the police and gave confessional statement before it.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Teghra P.S. Case No. 180 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
