The petitioner has renewed his prayer for grant of anticipatory bail in a case registered for the offences punishable under Sections 304B/34 of the IPC.
The accusation against the petitioner is of killing the daughter of the informant after four years of marriage for nonfulfillment of dowry demand. It is submitted by the learned counsel for the petitioner that though the postmortem report does not reflect any injury, but earlier prayer for bail of the petitioner was rejected considering the fact that the case was registered in the year 2010
Patna High Court CR. MISC. No.862 of 2019(2) dt.17-04-2019 2/2 while the earlier application was preferred with a prayer for anticipatory bail on 15.12.2014. It is further submitted that now the petitioner has renewed his prayer for grant of anticipatory bail on the ground that the investigation is still pending. This Court did not find any reason to revise the earlier order.
Accordingly, the prayer for grant of anticipatory bail of the petitioner is rejected.
Let, the learned Court below consider the prayer for regular bail of the petitioner, if he surrenders before the learned Court below within a period of six weeks in connection with Hathauri P.S. Case No.210 of 2010 pending in the Court of learned Sub-Judge-cum-ACJM 10th, Muzaffarpur. With the above observation, the application stands disposed of.
