JUSTICE SANJAY PRIYA ORAL ORDER 22-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Section 354(A) of the Indian Penal Code and Section 12 of POCSO Act.

It is alleged that when the informant was returning after taking tuition, the petitioner teased her and also caught hold her hands with bad intention.

It has been submitted that a compromise has taken place between the parties and a compromise petition has been filed in the lower court, copy of which is enclosed as Annexure-2. It has further been submitted that the petitioner has no criminal antecedent.

Considering the general and omnibus allegation

Patna High Court Cr.Misc. No.7062 of 2017 (2) dt.22-02-2017 2/2 against the petitioner and a compromise entered into between the parties, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner within six weeks from today, in connection with POCSO Case No. 54 of 2016 arising out of Gaya Kotwali P.S. Case No. 365 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 1st cum Special Judge (POCSO Act), subject to the conditions as laid down under Section 438 (2) Cr. P.C.
