The petitioner is in judicial custody in connection with Jadiya P.S. Case No. 261 of 2021 for the offences under Sections 461, 379 of the Indian Penal Code.

As per the FIR, the informant who is the owner of "New Gayatri Jewellers", Jadiya alleged that on 08.12.2021, when he opened his shop, he found the goods scattered and jewelleries (7 K.G. silver and 45 Grams golden) were stolen. Accordingly, the FIR was lodged.

Earlier the case was taken up and vide an order dated 21.09.2022 was rejected in Cr. Misc. No. 25123 of 2022. Once again the present petition was filed.

Considering the fact that the petitioner is in custody

Patna High Court CR. MISC. No.22692 of 2023(2) dt.12-04-2023 2/3 since 14.01.2022 (as stated in para-4 of the petition) and do not have criminal antecedent, this Court is inclined to grant him privilege of bail with conditions.

Let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each in connection with Jadiya P.S. Case No. 261 of 2021 to the satisfaction of learned A.C.J.M., V, Supaul, subject to following conditions:

(i) one of the bailor should be the family member of the petitioner who shall provide official document to show his bona fide;

(ii) the petitioner shall appear on each and every date before the Trial court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial court itself;

(iii) the petitioner shall appear before the concerned police station every fortnight for next six months to mark attendance;

(iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
