The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 307, 120B and 34 of the Indian Penal Code, section 27 of the Arms Act and section 17 CLA Act.

As per the prosecution case, while some of the prisoners were returning after their production in Court, two accused persons started firing and raising slogans. As a result of firing one of the accused died. One of the miscreants was caught and disclosed his name as Vikash Mahto and also disclosed the name of his associates.

It is submitted by learned counsel for the petitioner that the petitioner is not named in the FIR. His name transpires

Patna High Court CR. MISC. No.36017 of 2021(4) dt.25-01-2022 2/2 in course of investigation in the confessional statement of coaccused Vikash Mahto made before police. The petitioner was in Motihari jail on the date of occurrence. He is in custody in the instant case since 21.9.2020 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for 1 year 4 months, the petitioner is directed to be enlarged on bail in connection with Dumra P.S. Case no. 336 of 2018 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Sitamarhi.
