The petitioner apprehends arrest in connection with Patliputra Police Station Case No 241 of 2016 instituted for the offence under Sections 341, 323, 504, 506, 307/34 of Indian Penal Code.

As per written report, this petitioner along with two other accused persons assaulted the informant with iron rod. Injury report has been annexed as Annexure 2 which shows that dressed wound with stitches given on scalp was found and two superficial injuries were found on right shoulder and lower back. The injuries were opined to be simple in nature caused by hard and blunt substance. It is further submitted that the petitioner is not accused in any other case. In the written report, no specific

Patna High Court Cr.Misc. No.12952 of 2017 (4) dt.17-05-2017 2/2 allegation of any overt act has been attributed against the petitioner and other two accused persons.

In the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner above named within six weeks from today in connection with Patliputra Police Station Case No 241 of 2016, he shall be released on anticipatory bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 01st Class, Patna subject to the conditions as laid down in Section 438 (2) of Criminal Procedure Code with further conditions (1) bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned, (2) petitioner shall cooperate in the trial and shall be present on each and every date fixed by the Court and absence on two consecutive dates without proper and reasonable reason will automatically cancel bail bond of the petitioner and (3) if petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
