The petitioner seeks regular bail in connection with Bihta P.S. Case No. 751 of 2018, registered for the offence punishable under Sections 25(1-b)a/26/35 of the Arms Act. The allegation against the petitioner is that when he was apprehended by the police, a search was made and a country made pistol along with three live cartridges were recovered.

The learned counsel for the petitioner submits that the petitioner is having a clean antecedent and he has been falsely implicated in the present case. The petitioner is stated to be languishing in custody since 11.07.2018. Having regard to the facts and circumstances of the

Patna High Court Cr.Misc. No.72321 of 2018(2) dt.12-12-2018 2/2 case, I deem it fit and proper to direct for grant of regular bail to the petitioner immediately upon completion of six months of custody i.e. with effect from 11.07.12018, subject to such conditions as may be imposed by the learned trial court in connection with Bihta P.S. Case No. 751 of 2018, pending before the learned court of A.C.J.M.-1 Danapur, Patna. The petition stands disposed of on the aforesaid terms.
