JUSTICE ANIL KUMAR SINHA ORAL ORDER 10-12-2021 Heard Mr. Pramod Ban Bihari Singh, learned counsel for the petitioner and Mr. Binod Kumar, Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Mashrakh PS Case No. 107/2021 registered for the offence punishable under Section 414 of the IPC.
As per prosecution case, in brief, a stolen motorcycle has, allegedly, been recovered from the possession of the petitioner.
Learned counsel for the petitioner submits the petitioner is in custody since 23.02.2021 having no criminal antecedents. Learned counsel further submits that the motorcycle, in question, has been recovered from the joint family property in which other family members also reside and the father of petitioner is in scrap business. Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner is in custody since 23.02.2021 having no criminal antecedents and the charge-sheet in the matter has already been submitted, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, MANTOSH KUMAR be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Kiran Ojha, learned Judicial Magistrate, 1st Class, Saran at Chapra/successor Courts.
