The petitioner has preferred this application for grant of regular bail in a case registered under sections 8 and 20(b)(ii) (A) of the N.D.P.S Act As per the prosecution case, 500 grams of ganja was recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. He has been falsely implicated in the case. He is in custody since 3.12.2021 and has no criminal antecedent. Even the alleged quantity of ganja recovered would come in the category of small quantity. Investigation in the case has concluded.

No.22351 of 2022(2) dt.06-05-2022 2/2 Having heard learned counsel for the parties and taking into consideration the allegation of recovery of 500 grams of ganja together with the petitioner not having any criminal antecedent, having remained in custody for 5 months and charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Karja P.S. Case no. 242 of 2021 corresponding to N.D.P.S Case no. 11 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge I, Muzaffarpur.
