JUSTICE RAJIV ROY ORAL ORDER 13-08-2025 Heard Mr. Ashok Kumar Jha, learned counsel for the petitioner as also Mr. Kumaresh Singh representing the informant beside the learned APP for the State.

2. The petitioner is in judicial custody in connection with Sursand P.S. Case No. 581 of 2024 for the offence punishable under Sections 103(2) BNS Act lodged on 13.12.2024 by the informant, Manju Devi.

3. As per the FIR, the lady alleged that in a minor dispute between the children, the scuffle took place between the husband(deceased), Rahul Ram who gave axe blow on the back of the head. He was severally injured and later died at Sursand Primary Health Centre. This led to the FIR.

4. Learned counsel for the petitioner submits that

No.24455 of 2025(3) dt.13-08-2025 2/2 there was no intention to kill the informant's husband, learned counsel for the informant submits that a bare perusal of the FIR would show that purposely the axe was used on the head, the most vital part of the body which proved fatal.

5. In that background, no relief can be extended.

6. The bail application stands rejected.
