This application is for grant of bail in connection with Rail Katihar Police Station Case No.30 of 2016 for the offence under Sections 8, 20, and 22 of the N.D.P.S.Act.
The argument as advanced by the learned counsel for the petitioner that nothing has been recovered from the possession of the petitioner rather from the seat of the petitioner, a bag was recovered, in which 12 kg. Ganja have been recovered and the petitioner is in custody for about nine months. Heard learned A.P.P. also, who has opposed the prayer for bail.
Having heard both sides. In view of the fact that a huge quantity of Ganja has been recovered, I am not inclined to grant
Patna High Court Cr.Misc. No.38508 of 2016 (3) dt.20-02-2017 2/2 bail to the petitioner and considering the fact that the petitioner is in custody for about nine months, the learned trial court is directed to expedite the trial and try to conclude it within a period of one year.
With the aforesaid observation, this application is dismissed.
