Petitioners seek bail in Phulwarisharif P.S. Case No.427 of 2017 registered under Section 306 of the Indian Penal Code.

The father of the victim alleged that Guddu Kumar, son of petitioner no.1 used to come to his house to impart tuition to his daughter but Guddu Kumar sexually exploited his daughter on the pretext of marriage but when Guddu Kumar refused to marry with his daughter, his daughter lodged a case in which Guddu Kumar went inside jail. It is further stated that when Guddu Kumar came out from the jail, these two petitioners used to hurl obscene and vulgar comment on account of which his daughter committed suicide.

Patna High Court Cr.Misc. No.73711 of 2018(2) dt.12-12-2018 2/2 Learned counsel for the petitioners submits that the petitioners are father and brother of Guddu Kumar. They never came across with the girl. After death of the victim, the informant made allegations against the petitioners only because they happened to be the father and brother of Guddu Kumar. The girl herself committed suicide out of her depression. Considering the facts aforesaid and nature of allegations made against the petitioners and the fact that the petitioners are father and brother of Guddu Kumar, petitioners, above named, are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJMcum-Sub-Juge-XV, Patna in connection with Phulwarisharif P.S. Case No.427 of 2017.
