The petitioner seeks regular bail in connection with Akbarpur P.S. Case No. 708 of 2021 lodged under Sections 302, 498(A) and 201/34 of the Indian Penal Code.
The prosecution case is that the marriage of the informant's daughter solemnized with Nitish Kumar, eight years ago and allegation of assault for dowry has been made and thereafter information with regard to murder of the daughter of the informant was received by him on 18.11.2021 by the villagers, thereafter he filed the case. The son and the father, namely, Nitish Kumar and Shailendra Singh (petitioner) have been arrested from the spot.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.22771 of 2022(2) dt.27-07-2022 2/3 marriage has solemnized 8 years ago but even after lapse of 8 years, there was no kid to his son and deceased (daughter-inlaw). He further submits that there is general and omnibous allegation against all the accused persons including the petitioner, who is father-in-law and aged about 57 years. Learned counsel for the petitioner further submits that husband is already in custody and petitioner is in jail since 20.11.2021. He further submits that charge sheet has already been submitted and there is no criminal antecedent of the petitioner. Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Akbarpur P.S. Case No. 708 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C. (Dr. Anshuman, J.) ravishankar/- U T
