1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Gaurichak Police Station Case No. 754 of 2022, disclosing offences under Sections 147, 341, 323, 324, 307, 379, 354, 504, 506 of the Indian Penal Code.

3. As per the First Information Report, the petitioner along with other accused persons arrived at the home of the informant and assaulted him due to which the informant sustained head injury.

4. Learned Counsel for the petitioner submits that there is no specific allegation of assault against the petitioner and allegation against him is general and omnibus in nature. He further submits that the co-accused persons against whom there is specific allegation of assault, namely Indrajeet Yadav, Mukesh Yadav, Pintu Yadav, Dablu Yadav, have been granted anticipatory bail by this Court in Cr. Misc. No. 62628 of 2023 and Cr. Misc. No. 57518 of 2023. The injury caused to the informant is simple in nature as would be evident from the

Patna High Court CR. MISC. No.24471 of 2024(2) dt.03-04-2024 2/2 injury report at Annexure 3. The petitioner is having no criminal antecedent.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that there is general and omnibus allegations against the petitioner, the coaccused persons have been granted anticipatory bail by this Court and the injury caused to the victim is simple in nature, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial MagistrateVI, Patna City, in connection with Gaurichak Police Station Case No. 754 of 2022, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
