The petitioner is in custody in connection with Bakhri P.S. Case No. 397 of 2019 for the offence under Section 394 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner was not named in the first information report and his name has transpired on the confessional statement of Prakash Mahto. He further submits that the petitioner has not been put on test identification parade.
Considering the fact that the petitioner is in custody since 20.01.2020, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five
