2. The petitioner apprehends his arrest in connection with Rail Muzaffarpur P.S. Case No. 327 of 2023 registered for the offences punishable under Section 30 (a) of the Bihar Prohibition & Excise (Amendment ) Act, 2018.

3. As per the prosecution case, total 21 litres of illicit english wine has been recovered from two accused persons at platform no. 1, Muzaffarpur Railway Station.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that there is no recovery made from the petitioner and he was not apprehended on the spot. Petitioner is

Patna High Court CR. MISC. No.28799 of 2024(2) dt.15-05-2024 2/2 a student and preparing for competitive examination and except the confessional statement of the co-accused Abhishek Kumar there is no material against the petitioner. Petitioner has no criminal antecedent.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

6. Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise III, Muzaffarpur in connection with Rail Muzaffarpur P.S. Case No. 327 of 2023.
