JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 05-10-2016 Earlier the prayer of bail of the petitioner was allowed vide order dated 16.07.2014 passed in Cr. Misc. No. 23922 of 2014 but the petitioner did not remain present on each and every date in the court concerned and as such the bail bond was cancelled and again his prayer of bail has been rejected. Submission is that the condition was to remain present during trial. The trial has not started and as such the petitioner in that confusion did not appear before learned court below, in near future he undertakes not to commit such misuse. Learned APP fairly submits that the petitioner was allowed bail.

In the facts and circumstances stated above, the

Patna High Court Cr.Misc. No.42810 of 2016 (2) dt.05-10-2016 2/2 petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount to the satisfaction of the Learned A.C.J.M IVth, Bhojpur at Ara in connection with Shahpur P.S. Case No. 24 of 2014, subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
