The petitioner apprehends his arrest in connection with Sheohar P.S. case No. 192 of 2016 instituted under Sections 420, 406 & 120-B of the Indian Penal Code.

The allegation, in brief, is that the informant entered into an agreement with M/s Mahindra & Mahindra Finance Company for sanction of loan for purchase of vehicle. It is alleged that Rs. 25,000/- was given to the petitioner along with six blank cheques issued by him as security has not been returned back. It is submitted on behalf of the petitioner that the petitioner is one of the executive of M/s Mahindra & Mahindra Finance Company.

Patna High Court Cr.Misc. No.5693 of 2017 (2) dt.07-02-2017 The informant applied for loan but the company inspected his financial position and did not find him suitable therefore, denied the loan and initial money deposited was returned back. It is further submitted that the company is ready to return six blank cheques subject to the condition that he turns up and receives it. There is no cheating and misappropriation done by the petitioner or the company.

Considering the aforesaid facts and circumstances of the case, let the petitioner, namely, Chandan Kumar in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Sheohar P.S. case No. 192 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
