Mr. A.M.P. Mehta, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-01-2021 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Phulparas P.S. Case No. 169 of 2018, registered under Sections 363, 366 and 366(A) of the Indian Penal Code.

The accusation is that in the night of 05/06-08-2018, on calling of Phulchand Kamat, father of the informant, Deokant Kamat, informant woke up then saw that the door of his minor daughter is opened and she is not at the house. In course of search, he received phone about lying of bag of his minor daughter at the door of Nagmani Kumar then he went there and found the bag but Praveen Kumar (petitioner), son of Nagmani Kumar was not at his house. Informant raised suspicion about enticing away his minor daughter by Praveen Kumar (petitioner).

No.22122 of 2020(4) dt.11-01-2021 2/2 Learned counsel for the petitioner submits that, in fact, due to love affairs petitioner and the daughter of the informant, who was major, left the village but one day after the occurrence, both were apprehended by the police and handed over to their parents but on next day, daughter of the informant was found dead in his house. Thereafter, on the basis of Fradbeyan of Choukidar, Noor Mohammad, Phulparas P.S. Case No. 171 of 2018 was instituted against Deokant Kamat, informant of the present case under Sections 302/34, 120(B) and 291 of the Indian Penal Code for killing of his daughter due to prestige. Further submission is that at the time of occurrence the daughter of the informant was major.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Jhanjharpur, Madhubani, in connection with Phulparas P.S. Case No. 169 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
