2. The petitioner seeks bail in connection with Sahpur P.S. Case No. 140 of 2023 registered for the offence punishable under Sections 341, 323, 307, 504, 506, 34 of the Indian Penal Code.
3. Allegation against the petitioner is that he along with one Basant Nonia assaulted the son of the informant on his head due to which he sustained head injury.
4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case due to ulterior motive. No such occurrence, in the manner as alleged, has ever taken place. The allegation levelled against the petitioner is
Patna High Court CR. MISC. No.32854 of 2024(5) dt.06-09-2024 2/2 totally false and based on concocted facts. The injury report of the injured does not support the prosecution case. It is further submitted that the similarly situated co-accused, namely, Basant Nonia has been enlarged on bail by this court vide order dated 03.04.2024 passed in Cr. Misc. No. 12434 of 2024. Petitioner has no criminal antecedent and he has been languishing in custody since 06.11.2023.
5. Learned APP for the State opposes the prayer for bail.
6. Considering the facts and circumstances of this case and the period of custody of the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/Successor Court in connection with Sahpur P.S.
