JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-08-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the informant is languishing in custody since 6.7.2016 in a case registered under Section 498A of the Indian Penal Code and sections 3 and 4 of Dowry Prohibition Act.
The basic accusation is of torture for non fulfillment of dowry demands.
It is submitted by the learned counsel for the petitioner that the petitioner admits his marriage with the informant and the petitioner is ready to keep the informant as wife with full dignity and honour. Statement to that effect has been made in paragraph 5 of the petition which reads as follows:
"That it is stated that the petitioner is the husband of the
Patna High Court Cr.Misc. No.37937 of 2016 (2) dt.31-08-2016 2/2 informant who was/is ready to keep her with full dignity and honour. "
Considering the nature of accusation and the present stand of the petitioner, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Begusarai in connection with Begusarai Mahila P.S. Case No. 18 of 2016.
