JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 379 and 411/34 of the Indian Penal Code.

One stolen transformer was recovered on the information supplied by the Junior Engineer, Bihar State Power Holding Corporation from a magic vehicle. The driver of the vehicle Tamjeed Alam conveyed that the transformer was stolen by this petitioner who works for one Pawan Kumar Rai, a petty contractor under a private power company.

It is submitted by learned counsel for the petitioner that admittedly the recovery has not been made from the petitioner. The name of the petitioner sprang up on the confession of co

Patna High Court Cr.Misc. No.537 of 2015 (4) dt.29-01-2015 2/2 accused. It is further submitted that co accused Pawan Kumar whose name also sprang up in the confessional statement of the driver of Tata Magic vehicle, has been granted anticipatory bail vide Cr. Misc. No. 28005 of 2014. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Samastipur in connection with Musrigharari P.S. Case No. 36 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
