JUSTICE SUDHIR SINGH ORAL ORDER 08-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 272 and 273 of the Indian Penal Code and Sections 47, 53 and 54 of the Indian Excise Act.

Allegation against petitioner is that two litres of country made wine was recovered from his possession.

It has been submitted on behalf of petitioner that he is in custody since 30.7.2016. He has got no criminal antecedent. Chargesheet has been submitted against petitioner. It is alleged that two litres of country made liquor is said to have been recovered from possession of petitioner. No compliance under Section 100 of the Code of Criminal Procedure is made. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like

Patna High Court Cr.Misc. No.52018 of 2016 (2) dt.08-12-2016 2/2 amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sikrahna at Dhaka, East Champaran in connection with Ghora Sahan P.S. Case no. 274 of 2016.
