JUSTICE SATYAVRAT VERMA ORAL ORDER 05-07-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State alongwith learned counsel for the informant. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 379, 504, 506/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a person with one antecedent and the informant alleges that he is a businessman and while he was going from IIM Bodhgaya to Magadh University when the accused persons including the petitioner intercepted him abused him and assaulted him saying that it was there area and no one can supply material in that area except them, thereafter it is alleged that this petitioner and Chhotu kept pistol on his neck and putting him under fear snatched Rs. 1,00,000/- alongwith

Patna High Court CR. MISC. No.21889 of 2023(2) dt.05-07-2023 2/3 Golden Chain and on alarm local people came when the informant was saved.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case it is next submitted that from perusal of the allegation as alleged in the FIR it would manifest that the allegations are general and omnibus in nature with respect to snatching of Rs. 1,00,000/- and a Golden Chain and putting the informant under fear on point of fear is ornamental.

Learned A.P.P. for the State and learned counsel for the informant opposes the prayer for anticipatory bail of the petitioner and submits that petitioner has not approached this Court with clean hands, it is next submitted that at para 3 it has been pleaded that petitioner has one antecedent when petitioner has antecedent of two cases other being Bodhgaya P.S. Case No. 395 of 2019.

It is next submitted that petitioner is a muscleman of his area and is a criminal and does not want any other businessman to enter his domain so that he carries on with his business by way of monopoly.

Considering the submissions made by the learned counsel for the informant the Court is not inclined to extend the
