This application for grant of regular bail arise out of Pirpainti P.S. Case No. 375 of 2022 registered for the offence punishable under Sections 147, 148, 149, 120B, 302 of the Indian Penal Code read with Sections 27 of the Arms Act. The allegation against the petitioner is that he along with co-accused persons named in the FIR, entered in a criminal conspiracy and committed murder of informant's brother Nishant Singh and nephew Harshdeo Singh by opening fire. The reason for the occurrence is said to be not returning of the amount borrowed.

Patna High Court CR. MISC. No.24102 of 2023(2) dt.18-05-2023 2/2 In this case, two persons have been killed by indiscriminate firing. The petitioner is one of accused of the case who has fired upon the deceased.

Though, learned Senior Counsel for the petitioner has argued that there is previous enmity between the parties but considering the fact that it is a case of double murder by indiscriminate firing, this Court is not inclined to grant bail to the petitioner.

Accordingly, the prayer of bail of the petitioner is rejected herewith.

The Trial Court is directed to expedite the trial at the earliest.
