The petitioner apprehends his arrest in Agam Kuan P.S. Case No. 264/15, registered for the offences punishable under Section 420 of the Indian Penal Code.
The informant alleged that the petitioner persuaded him to purchase a piece of land and in pursuance thereof he paid Rs. 7,01,000/- and the deed of agreement to sell was executed by Sudha Kumari.
It is submitted that firstly, Sudha Kumari executed deed of agreement in favour of the petitioner. Later on, she executed another deed of agreement to sell in favour of the informant. The petitioner neither persuaded the informant to purchase the land nor committed any fraud. Sudha Kumari who executed both the deed
Patna High Court Cr.Misc. No.44030 of 2015 (3) dt.17-12-2015 2/2 of agreement to sell has already been enlarged on anticipatory bail vide order passed in Cr. Misc. 46565/2015.
Learned counsel for the informant as well as learned A.P.P. however, vehemently opposed the prayer for bail. Considering the facts aforesaid and the fact that the executant of deed of agreement to sell has already been enlarged on bail and the petitioner is alleged to be a middleman, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate, Patna City in connection with Agam Kuan P.S. Case No. 264/15, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.)
