The petitioner seeks bail in Chausa P.S. Case No. 171 of 2018, instituted for the offence under Section(s) 302/34 of Indian Penal Code. Charge sheet has been submitted against the petitioner under Section 302 and 120(B)/34 of the Indian Penal Code.

It is alleged in the written report that on the date of occurrence this petitioner along with other co-accused entered into courtyard and dragged the daughter-in-law of the informant outside the house and committed murder. They also damaged the eye of the deceased.

The Police after investigation has found the

Patna High Court CR. MISC. No.21218 of 2019(4) dt.11-07-2019 2/2 allegation true against the petitioner and co-accused Mukesh Sharma for the offence under Sections 302 and 120(B)/34 of the Indian Penal Code.

Post mortem report is available in the case diary which shows the cause of death due to excess bleeding and brain injury. The eye was also damaged.

Therefore, this Court is not inclined to grant bail to the petitioner.

Prayer for bail of the petitioner stands rejected. The trial court is directed to expedite the trial and conclude the trial as early as possible preferably within a period of nine months.
