The petitioner is in custody in connection with Excise Case No. 151 of 2020 for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment ) Act, 2018. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 08.03.2020. He further submits that in the instant case total 35 litres of country made liquor was seized. He further submits that the petitioner has no concern with the motorcycle nor with the bag.
Considering the fact that the petitioner has no criminal antecedent and he is in custody since 08.03.2020, the Court is
Patna High Court CR. MISC. No.21023 of 2020(2) dt.29-06-2020 2/2 inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Special Judge, (Excise), Gaya in connection with Excise Case No. 151 of 2020.
