The petitioner is a holder of a license for running a fair price shop under the Public Distribution System. The license of the petitioner was cancelled only to be restored vide Memo No. 617 dated 02.12.2004 of the Licensing Authority-cum-Sub- Divisional Officer, Sadar, Ara in the light of judgment and order of this Court passed in C.W.J.C. No. 12036 of 2002 and C.W.J.C. No. 13868 of 2002 dated 08.04.2003, a copy of which is placed at Annexure-3 to the writ petition.
The grievance of the petitioner is that though his license continues to subsist and remains in operation but the
Patna High Court CWJC No.112 of 2015 dt.09-02-2015 allotments of foodgrains and kerosene are missing. He submits that he has represented before the Licensing Authority on 20.11.2014 in this regard but to no avail.
Having heard learned counsel for the parties and taking note of the grievance raised by the petitioner, this writ petition is disposed of with a direction to the Licensing Authority-cum-SubDivisional Officer, Sadar, Ara, Bhojpur to consider the grievance of the petitioner as taken note of hereinabove and dispose of the same in accordance with law and after opportunity of hearing to the petitioner, by a speaking order to be passed within three months from the date of receipt/ production of copy of this order.
