The petitioner seeks regular bail in connection with Khagaria (Gangour) Police Station Case No. 945 of 2019, registered for the offences punishable under Sections 379/411/467/468/471/34 of the Indian Penal Code. The allegation, as per the First Information Report, is that the police intercepted one motorcycle and arrested the petitioner and when the documents/papers of the motorcycle was asked for, he did not produce the same and disclosed that he had stolen the motorcycle in question along with other coaccused persons and after changing the number plate of the same, he was plying the said motorcycle.

No.23741 of 2020(3) dt.04-11-2020 2/2 Learned Counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has purchased the motorcycle in question for a sum of Rs. 15,000/-. He further submits that the petitioner has got no criminal antecedent and he is in custody since 22.12.2019. After having heard learned Counsel for the parties and taking into consideration the materials on record and the fact that the petitioner has got no criminal antecedent and he is in custody since 22.12.2019, I am inclined to grant bail to the petitioner.

This application is, accordingly, allowed.

Let the petitioner, above named, be released on bail, upon furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Khagaria (Gangour) Police Station Case No. 945 of 2019. It is further made clear that at the time of furnishing bail bonds, all the parties shall follow the guidelines regarding social distancing.
