Learned counsel for the petitioner undertakes to remove the defects within four weeks. In the eventuality of nonremoval of defects within undertaken period, the office will place the matter before the Bench.
This is the second attempt of the petitioner to approach before this Court for grant of bail. Earlier, vide detailed order dated 10.09.2021 passed in Cr. Misc. No. 9491 of 2021, the prayer for bail of the petitioner was rejected with a liberty to renew his prayer after framing of charge. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this
Patna High Court CR. MISC. No.23304 of 2022(2) dt.11-05-2022 2/2 case. It is further submitted that petitioner is not named in the F.I.R. The name of the petitioner surfaced in this case on the basis of confessional statement of co-accused. He further submitted that similarly situated co-accused has been enlarged on bail vide Annexure-4.
Considering the fact that earlier the prayer for bail of the petitioner was rejected with a liberty to renew his prayer after framing of charge but up till now charge has not been framed.
In that view of the matter, I am not inclined to enlarge the petitioner on bail. The prayer for bail is hereby once again rejected.
