The petitioner seeks regular bail in connection with Gaurichak P.S.Case no.335/18 registered for offences punishable under Sections 406/34 of the Indian Penal Code. Allegation against the petitioner as per FIR is of looting away the truck with what. The petitioner is not named in the FIR.

Submission of the learned counsel for the petitioner is that except confession there is nothing against the petitioner and he has not been put on TIP as well as there is no recovery. He is in custody since 24.9.2018 and the charge sheet has been submitted.

Heard learned A.P.P. also, who has opposed the prayer for

Patna High Court Cr.Misc. No.71553 of 2018(2) dt.10-12-2018 2/2 bail.

Having heard both sides and the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Patna City in connection with Gaurichak P.S.Case No.335 of 2018.

With the aforesaid observation, this application is allowed.
